People v. Lumpkin [1st Dept 1999

Appellate Division of the Supreme Court of New York, First Department
Oct 28, 1999
696 N.Y.S.2d 813 (N.Y. App. Div. 1999)

Opinion

October 28, 1999

Christopher Conroy, for Respondent.

Gary E. Eisenberg, for Defendant-Appellant.

ELLERIN, P.J., WALLACH, LERNER, RUBIN, BUCKLEY, JJ.

Judgment, Supreme Court, New York County (Harold Rothwax, J.), rendered October 5, 1995, convicting defendant, upon his plea of guilty, of robbery in the first degree, and sentencing him, as a second felony offender, to a term of 4+ to 9 years, unanimously affirmed.

Since the record of defendant's plea allocution confirms that he voluntarily and knowingly waived his right to appeal, appellate review of the denial of defendant's suppression motion is foreclosed.

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
