People v. Lugo

Appellate Division of the Supreme Court of New York, First Department
Feb 26, 1991
170 A.D.2d 376 (N.Y. App. Div. 1991)

Opinion

February 26, 1991

Appeal from the Supreme Court, New York County (Budd Goodman, J.).

The issue of whether the prosecutor's remarks and summation deprived defendant of a fair trial has not been preserved for appellate review for the reason that no specific objection was taken at trial (CPL 470.05; People v Rivera, 73 N.Y.2d 941). We have examined defendant's remaining contentions and find them to be both unpreserved and without merit.

Concur — Murphy, P.J., Sullivan, Rosenberger, Ross and Asch, JJ.
