The California Supreme Court has reversed this court’s decision in this case and remanded the matter for us to remand the case to the trial court with specific directions. We comply.

The judgment of dismissal is reversed, and the charges against defendant Daniel Lowe are reinstated. (People v. Lowe (2007) 40 Cal.4th 937, 947.)
