PEOPLE v. LOPEZ (BOBBY), SERNA (HERMINIO) & TRUJEQUE (JAMES)


Withdrawal of counsel allowed by order

Good cause appearing, the amended application of appointed counsel for permission to withdraw as appellate and habeas corpus/executive clemency counsel of record for appellant Herminio Serna, filed October 5, 2018, is granted.

The order appointing Conrad Petermann as habeas corpus/executive clemency counsel of record for appellant Herminio Serna, filed June 10, 2010, and the order further appointing Conrad Petermann as appellate counsel of record for appellant Herminio Serna, filed August 30, 2017, are each hereby vacated.

On the court's own motion, Michael Satris, in his capacity as the alternative assisting attorney on behalf of appellant Herminio Serna, is hereby appointed as interim appellate and habeas corpus/executive clemency counsel of record for appellant Herminio Serna.

Conrad Petermann is hereby directed to deliver to alternative assisting attorney Michael Satris, within 60 days from the filing of this order, all appellate and habeas corpus work product, trial files, and all other appellate and habeas corpus related materials that he has obtained from appellant Herminio Serna or from his trial counsel, experts, investigators, or paralegals, or from any other source.

The date for appointed counsel to file the appellant's opening brief on behalf of Herminio Serna is hereby vacated; the court will set a new due date for that filing in due course.

Corrigan, J., was absent and did not participate.
