People v. Lofton

Appellate Division of the Supreme Court of New York, Second Department
Dec 10, 1990
168 A.D.2d 513 (N.Y. App. Div. 1990)

Opinion

December 10, 1990

Appeal from the County Court, Westchester County (Cowhey, J.).

Ordered that the appeal is dismissed.

The defendant waived his right to appeal as part of his plea agreement. As we find that this waiver was made freely, knowingly, and voluntarily, the defendant's appeal must be dismissed (see, People v. Seaberg, 74 N.Y.2d 1). Mangano, P.J., Kunzeman, Sullivan and Ritter, JJ., concur.
