MOTION DECISION

An order of this Court having been entered on June 01, 2017 (M-2499), inter alia, assigning Janet E. Sabel, Esq., The Legal Aid Society, as counsel to prosecute defendant's appeal from a judgment of the Supreme Court, New York County, rendered on or about October 26, 2016, and a decision and order of this Court having been entered on or about October 5, 2021 (Appeal No. 14280) holding the appeal in abeyance and remanding the matter to the Court below for a Wade hearing, And assigned counsel having moved for an order abating the appeal by reason of appellant's death and remitting the matter to the trial court for proceedings to vacate the judgment of conviction and dismiss the indictment, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon motion papers including a valid, fully executed certificate of death.
