  1. State v. Dickerson

    2022 S.D. 23 (S.D. 2022)   Cited 6 times
In Dickerson, 973 N.W.2d at 264, the Court held that the State had not demonstrated that the trial court’s error was harmless beyond a reasonable doubt, as there was no evidence corroborating the witness’s testimony and the State’s case primarily depended on whether the jury accepted the witness's version of events.

The State directs this Court to two cases in which, like here, the witness had not yet applied for a U-Visa. See State v. Buccheri-Bianca, 312 P.3d 123 (Ariz.Ct.App. 2013); People v. Chavez Limon, 2019 WL 2635550 (Cal.Ct.App.). According to the State, these cases support the conclusion that Gomez Rojas's immigration status is not relevant to any issue at trial because he did not know about the U-Visa program until after he reported the crime and he was never promised anything in exchange for his cooperation.
