DECISION & ORDER ON MOTION

Motion by the appellant to extend the time to comply with a decision and order on motion of this Court dated July 5, 2011, which directed him to serve and file a replacement brief on an appeal from a resentence of the Supreme Court, Westchester County, imposed August 5, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and the appellant's replacement brief which was submitted to the Clerk of the Court is accepted for filing; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until October 7, 2011, and the respondent's brief must be served and filed on or before that date.
