DECISION AND ORDER ON MOTION

Motion, pursuant to CPL 460.15, for permission to appeal to this Court from order of Supreme Court, Albany County, dated January 29, 2014, for extension of time to file and serve supplemental pro se brief and to consolidate.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion for permission to appeal is referred to Justice Lahtinen, who makes the following decision: Motion granted, and it is further

ORDERED that the motion for an extension of time to file and serve the supplemental pro se brief is granted and the brief is deemed timely filed and served, and it is further

ORDERED that the motion to consolidate is granted to the extent that the appeal from the order of Supreme Court, Albany County, dated January 29, 2014, shall be heard together with the appeal from the judgment of conviction, and it is further

ORDERED that the record and brief on the appeal from the order of Supreme Court, Albany County, dated January 29, 2014, shall be filed and served on or before May 16, 2014.
