An appeal having been taken to this Court from an order of the Supreme Court, Bronx County, entered on or about March 08, 2023, and said appeal having been perfected, And defendant-appellant having moved to stay proceedings to enforce the aforesaid order pending hearing and determination of the appeal taken therefrom (Motion No. 2023-02276), And respondent having moved to dismiss the aforesaid appeal (Motion No. 2023-02321), Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,
It is ordered that defendant's motion for a stay is granted (Motion No. 2023-02276). The motion by respondent to dismiss the appeal is denied, without prejudice to raising the issue on appeal (Motion No. 2023-02321).
