PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. MARCUS LAVELL LEWIS, Defendant-Appellant.
Kent CC: 18-007500-FH 18-007727-FH
Brian K. Zahra David F. Viviano Richard H. Bernstein Elizabeth T. Clement Megan K. Cavanagh Elizabeth M. Welch, Justices
Bridget M. McCormack, Chief Justice.
On order of the Court, the application for leave to appeal the January 21, 2021 judgment of the Court of Appeals is considered. We DIRECT the Kent County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order specifically addressing: (1) the defendant's argument that his Fourth Amendment rights were violated because the search warrant failed to establish a sufficient nexus between the alleged drug trafficking and his home; and if so, (2) whether the Court of Appeals correctly concluded that the good faith exception to the exclusionary rule applied. People v Goldston, 470 Mich. 523 (2004).
The application for leave to appeal remains pending.
