ORDER DENYING REHEARING AND MODIFYING OPINION

Super. Ct. No. SCS 176087

THE COURT:

The People's petition for rehearing is denied.

It is ordered that the opinion, and filed on March 25, 2008, be modified as follows:

1. On page 2, in the first sentence, the citation "(§ 136, subd. (b)(1))" is deleted and replaced with "(§ 136.1, subd. (b)(1))."

2. On page 6, in the second sentence under subheading B, the citation "(§ 136, subd. (b)(1))" is deleted and replaced with "(§ 136.1, subd. (b)(1))."

3. On page 23, in the first paragraph under subheading 2.a., the sentence preceding footnote 10, beginning with the words "A criminal street gang . . . ." is deleted and replaced with the following sentence:

A "criminal street gang" (§ 186.22, subd. (f)) is defined generally as an organization having as one of its primary activities the commission of one or more enumerated offenses, having a common name or symbol, and whose members individually or collectively have engaged in the commission or attempted commission of two or more enumerated offenses. [Footnote 10 remains.]

There is no change in the judgment.
