DECISION & ORDER ON MOTION

Motion by appellant on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered November 13, 2015, to continue the stay of execution of the judgment, which was granted by the Supreme Court, Queens County, on December 24, 2015, and extended by decisions and orders on motions of this court dated April 22, 2016, August 24, 2016, November 3, 2016 and January 6, 2017, respectively.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the stay of execution of the judgment is extended pending the determination of the appeal on condition that the appeal be perfected by May 5, 2017; and it is further,

ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
