THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ROBERT J. LAW, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Appellant having moved for an extension of time to perfect the appeal taken from the judgment of Ontario County Court rendered December 15, 2008,

Now, upon reading and filing the affirmation of James F. Miller, Esq. dated August 15, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered May 17, 2011 is hereby amended by striking therefrom the date August 15, 2011 and inserting in place thereof the date December 12, 2011, and

It is further ORDERED that James F. Miller, Esq. is relieved of his assignment to represent appellant, and

It is further ORDERED that Leanne Lapp, Esq.

Ontario County Public Defender's Office

is substituted as assigned counsel to prosecute the above-entitled appeal taken from a judgment of the Ontario County Court rendered December 15, 2008, in place of James F. Miller, Esq. and said appeal may be prosecuted upon one record as defined by 22 NYCRR 1000.3(c)(1) and ten copies of appellant's brief reproduced pursuant to CPLR 5529, and

It is further ORDERED that the Clerk of the County of Ontario is directed to provide Leanne Lapp, Esq. with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based.
