On order of the Court, the application for leave to appeal from the April 19, 2001 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court and because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D).

Cavanagh, J., would remand this case to the Court of Appeals as on leave granted.
