THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. PETER LAURENDI, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Defendant having moved pursuant to CPL 460.10(6) to extend the time to serve a notice of appeal from a judgment of the Supreme Court, Erie County, rendered October 9, 2012,

Now, upon reading and filing the affidavit of Peter M. Laurendi sworn to May 11, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal dated October 16, 2012 which was served upon the Erie County District Attorney on May 11, 2013 is hereby deemed timely served.
