THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. HOWARD D. LARKIN, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved to vacate the dismissal of the appeal taken from a judgment of the Steuben County Court, rendered January 17, 2019, and for other relief,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary to the extent that it seeks to vacate the dismissal, and

It is further ORDERED that the motion is granted to the extent that Mark C. Davison, Esq. is relieved of his assignment, and

It is further ORDERED that the appellant perfect the appeal on or before November 10, 2020, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
