THE PEOPLE, Plaintiff and Respondent, v. KEITH JAMES LAHUE, Defendant and Appellant.


Defendant Keith James Lahue pled no contest to battery with serious bodily injury (Pen. Code, § 243, subd. (d)) with the understanding that he would receive probation and a sentence of no more than 180 days in jail. According to the presentence report in the matter, the charge stemmed from an incident during which defendant repeatedly punched his wifes ex-husband, who had arrived early for a visit with his son and was waiting in his truck. Defendant also punched his sister in the face when she "attempted to get [the defendant] off of [the victim]." The victim sustained a broken wrist as a result of the incident.

The trial court placed defendant on probation with conditions that included a 90-day jail term. Defendant appealed.

We appointed counsel to represent defendant on appeal. Counsel filed an opening brief setting forth the facts of the case and, pursuant to People v. Wende (1979) 25 Cal.3d 436, requesting the court to review the record and determine whether there are any arguable issues on appeal. Defendant was advised by counsel of the right to file a supplemental brief within 30 days of the date of filing of the opening brief.

We have undertaken an independent examination of the record and have found no arguable error.

The judgment is affirmed.
