Opinion

June 30, 1943.

Appeal from a judgment of conviction of the crime of sodomy.


The proof did not establish defendant's guilt beyond a reasonable doubt. The question as to whether or not the boy involved was an accomplice should have been submitted to the jury as a question of fact in determining the necessity for corroboration of his testimony. Judgment of conviction reversed on the law and facts and a new trial granted. All concur.
