An appeal having been taken to this Court from the judgment of the Supreme Court, New York County, rendered on or about January 4, 2011,And assigned counsel for defendant having moved to be relieved as counsel for defendant or, in the alternative, for dismissal of the aforesaid appeal, without prejudice to reinstatement at such time appellant becomes amenable to the jurisdiction of this Court, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,It is ordered that the motion is granted to the extent of deeming the appeal withdrawn.
