Appellant having moved for a writ of error coram nobis vacating the order of this Court entered December 30, 1999 affirming a judgment of Erie County Court, rendered March 5, 1997,

Now, upon reading and filing the affidavit of John Moore sworn to January 11, 2018, the notice of motion with proof of service thereof, the affidavit of Matthew B. Powers, Esq. sworn to February 28, 2018, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.
