DECISION AND ORDER ON MOTION

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion for permission to appeal and to proceed anonymously is granted, without costs, and it is further
ORDERED that the motion to proceed on the original record is denied, without costs, and it is further
ORDERED that the motion for a preference is granted, without costs, to the extent that the appeal is set down for the January 2018 term of the Court. The record on appeal and brief of defendant shall be filed and served on or before September 29, 2017. The brief of the People shall be filed and served on or before November 13, 2017. The reply brief, if any, shall be filed and served on or before November 24, 2017.
