ORDER

The motion to waive fees is GRANTED for this appeal only.

The delayed application for leave to appeal is GRANTED, limited to Issue 1 as stated in the delayed application. MCR 7.205(E)(4). On the Court's own motion pursuant to MCR 7.216(A)(7), this case is EXPEDITED. The appellant's brief is due no later than 35 days from the Clerk's certification of this order. The appellee's brief is due no later than 21 days after service of the appellant's brief. The appellant may file a reply brief no later than 14 days after service of the appellee's brief. No extensions of time will be allowed for filing of the briefs except by order of the Court.

The clerk is directed to expedite the submission of this case on the session calendar in accordance with MCR 7.213(C)(7).

The motion to expand the record is DISMISSED as moot because the documents that defendant seeks to file are included in the lower court record.

On its own motion, the Court REMANDS the matter to the trial court for appointment of appellate counsel to represent defendant in this appeal. MCR 6.505(A). The trial court shall appoint appellate counsel forthwith. This Court retains jurisdiction.
