Summary Dispositions March 14, 1997:

In lieu of granting leave to appeal, the judgment of the Court of Appeals is reversed, and the judgment of the Kent Circuit Court is reinstated. MCR 7.302(F)(1). The Kent Circuit Court did not err in finding there was a sufficient factual basis for accepting the defendant's guilty plea to felony-firearm where the evidence shows the defendant assisted two armed accomplices, one possessing a sawed-off shotgun, by driving them to and past a dwelling for the purpose of shooting at the dwelling and then by helping them escape by driving them away from pursuing police. Leave to cross appeal is denied as moot.

I dissent from this Court's peremptory reversal of the Court of Appeals unanimous holding regarding the sufficiency of the evidence. The reasoning of the trial court here represents an extension of this Court's rulings in People v. Johnson, 411 Mich. 50 (1981), and People v. Wolfe, 440 Mich. 508 (1992). If this Court is to make such an extension, it should only do so after full briefing and arguments.
