Appeal from a judgment of the Supreme Court, Erie County (Joseph S. Forma, J.), rendered June 24, 2004. The judgment convicted defendant, after a nonjury trial, of felony driving while intoxicated, failure to signal, failure to drive on right side of road and failure to obey no-passing zone.
