ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

McKinster, Acting P.J.

The petition for rehearing is denied. The opinion filed in this matter on November 21, 2007, is modified as follows:

The last sentence of the first paragraph on page 3 is replaced with the following: “However, because of their positions with respect to the two men, the team members were unable to see whether the men’s hands touched or whether one man handed anything to the other.”

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
