PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. JOSEPH ALLEN KILCHERMANN, Defendant-Appellant.

Kent CC: 22-000631-FH

ORDER

On order of the Court, the application for leave to appeal the January 11, 2024 judgment of the Court of Appeals is considered. Pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we VACATE that part of the sentence of the Kent Circuit Court imposing $1,000 in court costs, and REMAND this case to that court. On remand, the circuit court shall articulate on the record the basis for imposing the costs. See People v Stevens, 318 Mich.App. 115, 120-121 (2016). In all other respects, leave to appeal is DENIED, because we are not persuaded that the remaining questions presented should be reviewed by this Court.
