Lynn W.L. Fahey, New York, N.Y. (Steven R. Bernhard of counsel), for appellant. Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano, Sharon Y. Brodt, and Ushir Pandit of counsel), for respondent.
Appeal by the defendant from a resentence of the Supreme Court, Queens County (Buchter, J.), imposed March 25, 2009, upon his conviction of conspiracy in the second degree under count one of the indictment, upon a jury verdict.

Contrary to the defendant's contention, the resentence imposed was not excessive ( see People v. Suitte, 90 A.D.2d 80, 455 N.Y.S.2d 675; see also People v. Muriel, 75 A.D.3d 908, 910–911, 905 N.Y.S.2d 363).
