Feb 1, 2011
81 A.D.3d 659 (N.Y. App. Div. 2011)

Opinion

No. 2010-04766.

February 1, 2011.

Appeal by the defendant from a judgment of the County Court, Nassau County (Donnino, J.), rendered March 24, 2009, convicting him of attempted murder in the second degree and criminal possession of a weapon in the second degree, upon his plea of guilty, and imposing sentence.

Patrick Michael Megaro, Uniondale, N.Y., for appellant.

Kathleen M. Rice, District Attorney, Mineola, N.Y. (Tammy J. Smiley and Cristin N. Connell of counsel; Matthew C. Frankel on the brief), for respondent.

Before: Rivera, J.P., Florio, Dickerson, Hall and Roman, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
