On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the September 11, 2001 judgment of the Court of Appeals and we REMAND the matter to the Kent Circuit Court for imposition of a maximum sentence of one year in jail for defendant's conviction of third-degree fleeing and eluding a police officer. MCL 257.602(A)(3).

We do not retain jurisdiction.
