People v. Keeley

Appellate Division of the Supreme Court of New York, Second Department
May 8, 1967
28 A.D.2d 545 (N.Y. App. Div. 1967)

Opinion

May 8, 1967

Motion by appellant to dispense with printing and for assignment of counsel on appeal from an order of the County Court, Nassau County, dated March 13, 1967. Motion denied. No separate appeal lies from an order denying a motion for a new trial (see Code Crim. Pro., § 517; People v. Trezza, 128 N.Y. 529, 532-533). Here, the order was made after the judgment of conviction had been affirmed (see Hebberd v. Loeb, 125 App. Div. 579). On the court's own motion, the appeal is dismissed. Christ, Acting P.J., Brennan, Hopkins, Benjamin and Munder, JJ., concur.
