Opinion

No. B166393.

10-28-2003

THE PEOPLE, Plaintiff and Respondent, v. SCOTT KEATING, Defendant and Appellant.

California Appellate Project, Jonathan B. Steiner, Executive Director, and Richard B. Lennon, Staff Attorney, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

Scott Keating appeals an order determining him to be a mentally disordered offender pursuant to Penal Code section 2962 et seq. and committing him to the Department of Mental Health for treatment.

We appointed counsel to represent Keating in this appeal. After counsels examination of the record, he filed an opening brief raising no issues.

On August 20, 2003, we advised Keating that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have received no response from him.

We have reviewed the entire record and are satisfied that Keatings attorney has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The order is affirmed.

We concur: COFFEE, J., PERREN, J.
