It is Ordered that the motion is denied without prejudice to defendant-appellant renewing this motion and submitting a affidavit disclosing the terms of his retainer agreement with private counsel, including the amount and sources of funds that he used to retain private counsel, and explaining why such funds are no longer available to defendant to prosecute this appal. Defendant-appellant should also explain why he can not use his real estate holdings to pay for counsel to prosecute this appeal. See Order
