THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ALEXANDER KATES, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from an order of the Monroe County Court, entered August 19, 2016,

Now, upon reading and filing the affidavit of Alexander Kates sworn to June 20, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal filed at the Monroe County Clerk's Office on May 23, 2017 and served upon the Monroe County District Attorney's Office on May 2, 2017 is hereby deemed timely filed and served.
