ORDER MODIFYING OPINION

THE COURT:

It is ordered that the opinion filed herein on August 24, 2012, be modified as follows:

On page 10, the first sentence under the heading "II." is removed and replaced with the following sentence:

Karlson contends the trial court erroneously denied his section 995 motion to dismiss because at the preliminary hearing the magistrate found insufficient evidence he actively participated in a criminal street gang; therefore, the admission of expert testimony regarding gangs was erroneous, and the counts one, two and five convictions must be reversed.

There is no change in the judgment.
