Appeal by defendant from a judgment of the County Court, Dutchess County (Aldrich, J.), rendered April 23, 1980, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence. Judgment affirmed. Under the circumstances herein we do not find custodial interrogation to have taken place prior to the giving of the Miranda warnings (see People v Yukl, 25 N.Y.2d 585). We see no merit in defendant's other contentions. Mollen, P.J., Gibbons, Weinstein and Rubin, JJ., concur.
