Motion No: 2020-00938 WCR

12-18-2020

The People of the State of New York, Respondent, v. Alan Kachalsky, Appellant.

TERRY JANE RUDERMAN

ELIZABETH H. EMERSON, JJ.

DECISION & ORDER ON MOTION

Motion by appellant on an appeal from a judgment of conviction of the Justice Court of the Village of Port Chester, Westchester County, rendered September 21, 2020, in effect for leave to prosecute the appeal on an abridged record (see, 22 NYCRR 731.9 [b][2]) dispensing with the transcripts.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted.

In support of the motion, appellant avers that the "sole issue [on appeal] is the sufficiency of the two informations," and that he does not intend to appeal the trial court's guilty verdict. Under the circumstances, and in the absence of opposition, the motion is granted.
