DECISION & ORDER ON MOTION

Appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered February 7, 2020. In a Decision & Order dated November 6, 2020, appellant's motion to vacate the dismissal for failure to prosecute was denied with leave to renew upon the filing of an affidavit by appellant setting forth a potentially meritorious appeal on or before December 18, 2020.

Upon the papers filed in response to the court's Decision & Order dated November 6, 2020, and no papers having been filed in opposition thereto, it is

ORDERED on the court's own motion that the motion to vacate is granted on condition that the appeal be perfected on or before February 26, 2021; and it is further

ORDERED that in the event the appeal is not perfected by February 26, 2021, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal on three days' notice and may serve such application upon appellant in person.
