People v. Jones

Appellate Division of the Supreme Court of New York, Second Department
Apr 25, 2006
28 A.D.3d 791 (N.Y. App. Div. 2006)

Opinion

2005-00754.

April 25, 2006.

Appeal by the defendant from a judgment of the County Court, Westchester County (Alessandro, J.), rendered February 17, 2004, convicting him of robbery in the first degree, upon his plea of guilty, and imposing sentence.

Barry E. Warhit, White Plains, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Michael Jeffrey Ashraf and Lois Cullen Valerio of counsel), for respondent.

Before: Adams, J.P., Goldstein, Fisher and Lifson, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
