ORDER

The motion to waive time limit of MCR 7.211(C)(5)(b) is GRANTED.

The motion to withdraw is DENIED for reason that the appeal is not wholly frivolous. Counsel for defendant-appellant shall have 35 days from the Clerk's certification of this order within which to file a brief in support of the application for leave to appeal addressing the following:

WHETHER THE REGISTRATION REQUIREMENTS FOUND IN THE MICHIGAN'S SEX OFFENDERS REGISTRATION ACT (SORA), MCL 28.721 ET SEQ., ARE UNCONSTITUTIONAL. See People v Lymon, 342 Mich.App. 46; 993 N.W.2d 24 (2022), lv gtd ___ Mich___; 983 N.W.2d 82 (2023); see also People v Jarrell, ___ Mich. App___;___ N.W.2d___ (2023) (Docket No. 356070), lv held in abeyance pending People v Lymon,___ Mich___; 994 N.W.2d 778 (2023); and People v Fabela (On Remand), unpublished per curiam opinion of the Court of Appeals, issued June 23, 2022 (Docket No. 337365), lv held in abeyance pending People v Lymon, ___ Mich. ___; 995 N.W.2d 133 (2023).
