MOTION DECISION

Defendant having moved for leave to prosecute, as a poor person, the appeal taken to this Court from a judgment of the Supreme Court, Bronx County, rendered on or about February 10, 2023, to relieve Patrick B. Higgins, Esq., assigned 18-B Counsel, and to assign Twyla Carter, Esq., The Legal Aid Society, as counsel to prosecute the appeal, and for an extension of time in which to perfect the appeal upon receipt of the transcribed minutes, and for related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew upon defendant's submission of a notarized affidavit, setting forth defendant's indigency pursuant to CPLR 1101(a), or upon submission of an affirmation by Patrick B. Higgins, Esq., representing that defendant continues to be eligible for assignment of counsel in compliance with CPL 380.55(2).
