ORDER

Douglas B. Shapiro, Judge, acting under MCR 7.211(E)(2), orders:

Defendant-appellant's pro se application for leave to appeal resulted in our Supreme Court's order remanding this matter to this Court for consideration as on leave granted. Because defendant-appellant was also unrepresented in this Court when filing his original delayed application for leave to appeal, it is now ordered on the Court's own motion that this cause is REMANDED to the Berrien Circuit Court for a determination of defendant-appellant's indigency within 14 days of the Clerk's certification of this order.

If defendant's indigency is established, the Berrien Circuit Court shall immediately appoint appellate counsel to represent defendant in this matter. A copy of an order appointment, if entered by the Berrien Circuit Court, shall be promptly sent to the Court of Appeals.
