MOTION DECISION

An appeal having been taken to this Court from a judgment of conviction of the Supreme Court, New York County, rendered on June 20, 2013, and said judgment having been unanimously affirmed by this Court on April 4, 2017 (Appeal No. 3615), and subsequently vacated by the New York State Court of Appeals, upon a finding of insufficient evidence, on November 27, 2018, And respondent having moved for an order unsealing certain audio recordings in the possession of the New York County District Attorney's Office, which were used as exhibits in the underlying criminal trial, to allow for the production of said audio recordings, delineated in the moving papers, to the parties for use in defendant's wrongful conviction lawsuit, which is pending in the New York State Court of Claims (Claim No. 133075), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted.
