PRESENT:

Defendant having moved to amend the order of this Court entered July 19, 2016 granting an extension of time pursuant to CPL 460.30, to file a late notice of appeal,

Now, upon reading and filing the affidavit of Glenn Jones sworn to September 13, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary.

Memorandum: Thomas D. Gallagher, Esq. filed a notice of appeal at the Erie County Clerk's Office on August 12, 2016 and served said notice upon the Erie County District Attorney's Office on August 11, 2016.
