In lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for consideration as on leave granted. MCR 7.302(F)(1). The Court of Appeals is instructed to specifically address the question of whether defendant has established "actual prejudice" as required by MCR 6.508(D). Did the trial court erroneously admit hearsay evidence at trial? If so, did defendant have a reasonably likely chance of acquittal but for the alleged error in light of the independent evidence presented by the prosecution to establish defendant's guilt? Court of Appeals No. 214300.
