On order of the Court, the delayed application for leave to appeal from the April 26, 2002, decision of the Court of Appeals, is considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D). The motions to appoint counsel and to add an issue are DENIED.

Cavanagh and Kelly, JJ., would remand the case to the Wayne Circuit Court for further proceedings.
