PRESENT:

Appellant having moved for permission to proceed as a poor person on the appeal taken from a judgment of Monroe County Court rendered June 28, 2017,

Now, upon reading and filing the affidavit of Chevas Johnson sworn to January 24, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the filing and serving of a motion containing proof that the notice of appeal has been timely served and an affidavit from defendant or counsel setting forth the nature and particulars of the legal representation of the defendant.
