Appeal from COA: 224757, Oakland CC: 97-153331-FC.

On order of the Court, the motion for immediate consideration is considered, and it is GRANTED. The application for leave to appeal from the May 19, 2000 decision of the Court of Appeals also is considered and, it appearing to this Court that the case of People v Daoud (Docket No. 113994) is pending on appeal before this Court and that the decision in that case may resolve an issue raised in the present application for leave to appeal, we ORDER that the application be held in ABEYANCE pending the decision in that case.

It is further ordered that proceedings in the Oakland County Circuit Court are STAYED until the further order of this Court.

Cavanagh and Kelly, JJ., would deny leave to appeal.
