People v. Johnson

Appellate Division of the Supreme Court of New York, Second Department
May 15, 1967
28 A.D.2d 554 (N.Y. App. Div. 1967)

Opinion

May 15, 1967

Judgment of the Supreme Court, Kings County, rendered August 4, 1965, affirmed. Under the circumstances herein, there was no abuse of discretion involved in the denial by the trial court of defendant's motion to withdraw his plea of guilty. That plea had been interposed near the close of the People's case after eight days of trial. Not only would the granting of the motion have prejudiced the People, but there was sound basis for the refusal of the trial court to accept defendant's protestations of innocence and accusations against his attorneys as the result of defendant's prior, unsolicited statements made in open court. Beldock, P.J., Christ, Brennan, Hopkins and Benjamin, JJ., concur.
