Submitted October 31, 2001.

December 24, 2001.

Appeal by the defendant from a judgment of the County Court, Dutchess County (Molea, J.), rendered April 3, 2000, convicting him of criminal possession of a controlled substance in the second degree, upon his plea of guilty, and imposing sentence.

Roderick W. Ciferri, Millbrook, N.Y., for appellant.

William V. Grady, District Attorney, Poughkeepsie, N.Y. (Bridget Rahilly Steller of counsel), for respondent.

Before: FRED T. SANTUCCI, J.P., MYRIAM J. ALTMAN, ANITA R. FLORIO, HOWARD MILLER, BARRY A. COZIER, JJ.

ORDERED that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see, Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 63l; cf., People v. Gonzalez, 47 N.Y.2d 606).

SANTUCCI, J.P., ALTMAN, FLORIO, H. MILLER and COZIER, JJ., concur.
